Warranty – General Terms and Conditions
Unless otherwise provided under a separate agreement or specific order/quote, LucensBright warrants that the products (the “Products”) will be free from de-fects in materials and workmanship under normal use for the following periods of time (the “Warranty Period”) from the date of manufacture:
- Indoor & decorative products: 2 years*
- Outdoor products: 5 years*
* The housing and finish are subject to a warranty of 10 years.
This warranty only applies when the Products are operated in compliance with the electrical requirements and within the normal operation range and the environmental conditions (e.g., temperature and humidity), and properly wired, installed, served and maintained by the authorized personnel in accordance with the Product specifications and Product User Manual. This warranty is void if the Products are used in abnormal conditions or improper applications, or otherwise used in violation of any applicable standard, code or instructions for installation or use. This warranty does not apply to the Products if the circumstances indicate that any defect or malfunction of the Products has resulted from accident, abuse, or other factors beyond control of LucensBright. This warranty is limited to the buyer of the Products and is not transferable or assignable, and excludes field labor or service charges related to the repair or replacement of the Product.
In case that any Product is found to be defective within the Warranty Period, the buyer of the Product shall notify LucensBright in writing immediately upon the notice of defect. Provided that the buyer provides the information requested by LucensBright, LucensBright may, at its sold judgement, either repair or replace the defective Product or, in the event that the defective Product is no longer manufactured, a replacement of the Product that is closest similar to the defective Product. For either repair or replacement of the Product, upon receiving a return authorization number (“RA#”) from LucensBright, the buyer shall promptly return the Product within thirty (30) days, with the shipping box clearly marked with RA#. This requirement for the return of Product is not applicable to the circumstances where LucensBright determines that it shall provide on-site repair services that may be deemed to be most cost effective. For purpose of this General Terms and Conditions, an element is considered as "defect" or "defective" only when such element directly causes the LED fixture as a whole to completely fail to illuminate.
The foregoing shall constitute the exclusive remedy of the buyer and the sole liability of LucensBright. LUCENSBRIGHT DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, FOR THE PRODUCTS AND ALL ACCOMPANYING WRITTEN MATERIALS. LUCENSBRIGHT RESERVES THE RIGHT TO INTERPRET THE WARRANTY TERMS AND CONDITIONS AND TO CHANGE THE WARRANTY PERIOD WITHOUT PRIOR NOTICE AND WITHOUT INCURRING OBLIGATION AND EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED IN THIS LIMITE WARRANTY. IN NO EVENT SHALL LUCENSBRIGHT OR ITS SUPPLIERS/DISTRIBUTORS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY OR NON-PECUNIARY LOSS), WHETHER INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE IN NATURE, ARISING OUT OF INSTALLATION, USE OR INABILITY TO USE THE PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
LucensBright reserves the right to examine the Products that are claimed to be failed for the purpose of determination of the cause of the failure and, in connection with any claim under this warranty, shall serve as the sole judge as to whether any of the Products are defective and covered by this warranty.
